What's a Sales Tax License? Why do I Need One as a Jewelry Designer?
A Sales Tax License, also known as a Seller’s Permit or Resale License, is a legal document that allows businesses to collect and remit sales tax on taxable goods and services they sell. Sales tax is typically imposed by state and local governments and varies depending on the jurisdiction. As a jewelry designer, obtaining a Sales Tax License is essential for several reasons:
Compliance with the law: If you are selling jewelry, whether online or in a physical store, you are required by law to collect sales tax from your customers and remit it to the appropriate tax authorities. A Sales Tax License ensures that you are in compliance with the regulations in your state or local jurisdiction, helping you avoid penalties, fines, or potential legal issues.
Purchasing supplies tax-free: As a jewelry designer, you may need to purchase raw materials, such as beads, gemstones, metals, and tools, for your creations. With a Sales Tax License, you can buy these supplies tax-free from wholesalers or suppliers since you intend to resell the final products. This is advantageous as it can help reduce your production costs and ultimately increase your profit margins.
Professionalism: Obtaining a Sales Tax License demonstrates to customers and suppliers that you are operating a legitimate business. This can help establish credibility and trust, which is particularly important when dealing with high-value items like jewelry.
Access to wholesale suppliers: Many wholesalers and suppliers require businesses to provide a Sales Tax License before they can purchase goods at wholesale prices. This allows them to ensure that they are dealing with legitimate resellers and not end consumers. Having a Sales Tax License grants you access to a broader range of suppliers, often with better pricing and product selections.
To obtain a Sales Tax License, you will need to apply through the appropriate tax agency in your state or local jurisdiction. The application process typically involves providing information about your business, such as its name, address, ownership structure, and estimated sales. That may sound intimidating but it’s really not a hard process! Once your application is approved, you will receive a Sales Tax License number, which you should display in your store or provide to customers and suppliers as needed. Remember to file and remit sales tax according to the deadlines set by your tax agency and to maintain accurate records of your transactions.
What's an EIN number? Does it Make Me Except from Sales Tax?
An EIN, or Employer Identification Number, is a unique nine-digit number assigned by the Internal Revenue Service (IRS) to businesses operating in the United States. It serves as a tax identification number for businesses and is used for various purposes, such as filing tax returns, opening bank accounts, and applying for business licenses and permits.
An EIN does not make you exempt from sales tax. Sales tax and EIN are separate aspects of business taxation. While an EIN is primarily used for federal tax purposes, sales tax is a state and local tax levied on the sale of goods and services. Even if you have an EIN, you are still required to collect and remit sales tax for the goods you sell, provided they are subject to sales tax in your jurisdiction. The folks at TaxJar have a great video explanation.
It is essential to understand that having an EIN does not automatically grant you a Sales Tax License or Seller’s Permit. To collect and remit sales tax legally, you need to apply for a Sales Tax License or Seller’s Permit through your state’s tax agency. This license allows you to collect sales tax from your customers on taxable goods and services and then remit it to the appropriate state or local tax authorities.
